BackgroundAn increasing number of studies utilize intracranial electrophysiology in human subjects to advance basic neuroscience knowledge. However, the use of neurosurgical patients as human research subjects raises important ethical considerations, particularly regarding informed consent and undue influence, as well as subjects’ motivations for participation. Yet a thorough empirical examination of these issues in a participant population has been lacking. The present study therefore aimed to empirically investigate ethical concerns regarding informed consent and voluntariness in Parkinson’s disease patients undergoing deep brain (...) stimulator (DBS) placement who participated in an intraoperative neuroscience study.MethodsTwo semi-structured 30-minute interviews were conducted preoperatively and postoperatively via telephone. Interviews assessed participants’ motivations for participation in the parent intraoperative study, recall of information presented during the informed consent process, and participants’ postoperative reflections on the research study.ResultsTwenty-two participants (mean age = 60.9) completed preoperative interviews at a mean of 7.8 days following informed consent and a mean of 5.2 days prior to DBS surgery. Twenty participants completed postoperative interviews at a mean of 5 weeks following surgery. All participants cited altruism or advancing medical science as “very important” or “important” in their decision to participate in the study. Only 22.7% (n = 5) correctly recalled one of the two risks of the study. Correct recall of other aspects of the informed consent was poor (36.4% for study purpose; 50.0% for study protocol; 36.4% for study benefits). All correctly understood that the study would not confer a direct therapeutic benefit to them.ConclusionEven though research coordinators were properly trained and the informed consent was administered according to protocol, participants demonstrated poor retention of study information. While intraoperative studies that aim to advance neuroscience knowledge represent a unique opportunity to gain fundamental scientific knowledge, improved standards for the informed consent process can help facilitate their ethical implementation. In this paper, we analyse the intersections between care and place in mundane spaces not explicitly designed for the provision of care, and where digital technologies are used to mediate ecologies of distress in the city. We locate our analysis alongside studies of how digital technologies impact the experience of care within non-clinical spaces, whilst noting that much research on the use of technologies for care remains haunted by clinical imaginaries. Bringing together ideas of multi-sited therapeutic assemblages, technogeographies of care, (...) and how places-by-proxy can act as conduits for care, we explore an example of an online app being used in public space to manage experiences of anxiety in an everyday urban environment. We reflect on this illustrative example to trace the movement of care as it is mediated through digital technologies—out of the clinic, beyond the home, and into the ordinary spaces of the city. We conclude that the entanglements of digital technologies and ordinary urban places prompt us to entirely reconsider questions of the where of care. (shrink)

As early-career neuroethicists, we come to the field of neuroethics at a unique moment: we are well-situated to consider nearly two decades of neuroethics scholarship and identify challenges that have persisted across time. But we are also looking squarely ahead, embarking on the next generation of exciting and productive neuroethics scholarship. In this article, we both reflect backwards and turn our gaze forward. First, we highlight criticisms of neuroethics, both from scholars within the field and outside it, that have focused (...) on speculation and lack of skepticism; the dearth of consideration of broader social issues such as justice and equality, both with regard to who speaks for neuroethics as a field and who benefits from its recommendations and findings; and the insufficient focus on the practical impact of our ethical work. Second, we embrace the concept of “translational neuroethics” to outline a vision for neuroethics that is integrated, inclusive, and impactful. Integration can help us identify more pertinent, real-world issues, and move away from speculation; inclusivity can help ensure that the questions we attend to are not merely relevant to a single subgroup but aim toward just distribution of benefits; and impact can help us think beyond guidelines and recommendations to focus on implementation. Our goal is for this call to action to help shape neuroethics into a discipline that develops rigorous research agendas through relationships with interdisciplinary partners, that is broadly inclusive and attends to issues beyond novel neurotechnologies, and that is devoted to the translation of scholarship into practice. Much indirect evidence supports the hypothesis that transformations of mental images are at least in part guided by motor processes, even in the case of images of abstract objects rather than of body parts. For example, rotation may be guided by processes that also prime one to see results of a specific motor action. We directly test the hypothesis by means of a dual-task paradigm in which subjects perform the Cooper-Shepard mental rotation task while executing an unseen motor rotation in (...) a given direction and at a previously learned speed. Four results support the inference that mental rotation relies on motor processes. First, motor rotation that is compatible with mental rotation results in faster times and fewer errors in the imagery task than when the two rotations are incompatible. Second, the angle through which subjects rotate their mental images, and the angle through which they rotate a joystick handle are correlated, but only if the directions of the two rotations are compatible. Third, motor rotation modifies the classical inverted V-shaped mental rotation response time function, favoring the direction of the motor rotation; indeed, in some cases motor rotation even shifts the location of the minimum of this curve in the direction of the motor rotation. Fourth, the preceding effect is sensitive not only to the direction of the motor rotation, but also to the motor speed. A change in the speed of motor rotation can correspondingly slow down or speed up the mental rotation. (shrink)

ABSTRACTThis work explores financial edgework by professional speculative traders as an explanation for the persistence of rogue trading in financial markets. The article joins in the scholarly application of “edgework,” the social psychological study of voluntary risk, to speculative trading. The discussion focuses on the origins and persistence of that subset of behavior wherein the trader knowingly creates the condition in which he or she endangers the brokerage house that employs them and even, at times, threatens the public's perception of (...) the integrity of the securities industry. Going over the edge between risk taking and unauthorized rogue trading is explained by looking at five inducements to escalate risk taking provided in the securities industry. This examination of financial edgework demonstrates how and, to a lesser degree, why rogue trading is a result of the security industry's pursuit of and desire to capitalize upon yet not publicize an occupational culture stressing a “risk‐and‐win” ethos. This paper provides an analysis of the dynamics of secrecy and the secrets business. Secrets are defined as bits of information that, for one reason or another, are kept hidden or controlled so as to elude attention, observation or comprehension. Three conceptual lenses — the micro-analytic focusing on self-deception, the social-psychological focusing on self-disclosure, and the macro-analytic focusing on public secrets — are probed. Secrecy at each of the three levels is revealed to be a janusfaced issue providing undeniable benefits (...) to Homo sapiens in their efforts to adapt to a changing world yet also creates undeniable problems. While secrecy provides the occasion for the demonstration of loyalty and intimacy, it also generates the conditions for exclusion and betrayal. The contemporary impulse to create public forums in which all is revealed, in which sunlight prevails, is too simple a panacea to those who use the topic of secrecy as an occasion to correct social, political and economic problems. This study describes which clinical ethics approaches are available to support healthcare personnel in clinical practice in terms of their construction, functions and goals. Healthcare personnel frequently face ethically difficult situations in the course of their work and these issues cover a wide range of areas from prenatal care to end-of-life care. Although various forms of clinical ethics support have been developed, to our knowledge there is a lack of review studies describing which ethics support approaches are available, how they (...) are constructed and their goals in supporting healthcare personnel in clinical practice. This study engages in an integrative literature review. We searched for peer-reviewed academic articles written in English between 2000 and 2016 using specific Mesh terms and manual keywords in CINAHL, MEDLINE and Psych INFO databases. In total, 54 articles worldwide described clinical ethics support approaches that include clinical ethics consultation, clinical ethics committees, moral case deliberation, ethics rounds, ethics discussion groups, and ethics reflection groups. Clinical ethics consultation and clinical ethics committees have various roles and functions in different countries. They can provide healthcare personnel with advice and recommendations regarding the best course of action. Moral case deliberation, ethics rounds, ethics discussion groups and ethics reflection groups support the idea that group reflection increases insight into ethical issues. Clinical ethics support in the form of a “bottom-up” perspective might give healthcare personnel opportunities to think and reflect more than a “top-down” perspective. A “bottom-up” approach leaves the healthcare personnel with the moral responsibility for their choice of action in clinical practice, while a “top-down” approach risks removing such moral responsibility. The target article distinguishes between modal and amodal emulators (the former predict future sensory states from current sensory states and motor actions, the latter operate on more abstract descriptions of the environment), and motor and environment emulators (the former predict the results of one's own actions, the latter predict all changes in the environment). I question the applicability of modal emulators, and the generalization to environment emulators.

Within US media reactions to March of the penguins, animal images became an arena for displaced conflicts of human interest. This paper examines an intermediary step through which the film became a medium for social disagreement: conflict over control of the cultural authority to interpret animal images. I analyze claims to the cultural honorific of science made within disputes over readings of the film as evidence for intelligent design . I argue that published refutations of this reading were largely misguided (...) in that they tended to group arguments-for-ID with a suite of social–allegorical readings of the film. By failing to address essential differences between interpretations, critics of the arguments-for-ID necessarily overlooked their problematic and unexamined claim that the film shares the cultural authority of science. Furthermore, where critics of the ID readings might have challenged this claim, they often replicated it instead. This overarching failure critically to assess the status of the film’s scientific authority may have resulted from audience expectations about the genre of wildlife films, the advertising strategy of the film’s US distributors, and structural ambiguities within the film concerning its status as a scientific representation. In Politics III.10 and IV.4, Aristotle discusses the difference between governments that are regulated by the rule of law and those that are not. Although he concludes that the rule of law helps guard against arbitrary and injudicious government action, Aristotle is also sensitive to the fact that in a democracy it is essential for the people to remain sovereign over the law. His discussion is helpful for understanding, not only the tension between the 'rule of law' and the 'rule (...) of men', but also the complex role the rule of law plays in any modern democracy. This essay presents a reading of the work of two central figures of modern social theory that locates their work within not simply mainstream Jewish thought, but a particular Hasidic tradition. Further, I argue that lying behind this, in a repressed form, is an even older tradition of Jewish alchemy. I make no claim to have evidence that either Freud or Durkheim were directly influenced by Hasidism or alchemy, but I examine the parallels between the structure of their thoughts and (...) those of the two traditions. Both Freud and Durkheim display a social psychology that is analytically similar to the dualism of Hasidism's Tanya and the general transformational models of alchemy. This formal model is in opposition to the messianic tradition in Jewish thought and analyzes Freud and Durkheim as anti messianic social psychologists. Hasidism offers a template for modern theories of social psychology, social interaction and the relation between the social and the individual, that is, collective identity. This essay also considers more generally how modern social theory might make sense of contemporary social phenomena by opening itself to the messianic and mystical traditions in Jewish thought. I suggest that the social and structural transformation associated with the information or network society requires new analytic tools that allow us to explain social energy differently to the way Freud and Durkheim have guided social theory. Contemporary analyses of individualization, social movements and sacralization as forms of and reactions to alienation are inadequate. Instead, I ask whether we should not 'restore a messianic, truly utopian "lost unity", which the alchemical, secular gnosis of modern social science displaced, and so renew social theory?'. (shrink)

An assessment of America's preference for "extra-large" shares examples ranging from mega churches and breast augmentation to landfills and mega-malls, in a cautionary report that reveals some of the consequences of these choices.

The paper begins by engaging Mircea Eliade’s undervaluation of the importance of classical sociology of religion, namely, Durkheim and Weber, and goes on to show how much they share with him, particularly with regard to a critique of modern European civilization, and of the foundational importance of religion in society. This “other”, non-positivist, non-reductionist face of Durkheim and Weber is elaborated by showing their religious, even “primordial” approaches to the religious bases of society and culture. Eliade’s criticism of sociology is (...) further misplaced, given the decline of the sociological regime of knowledge, and the accuracy of Eliade’s prescient expectation of a cosmic rather than historical orientation, and the current importance of religion and “spirituality” for socio-cultural life, generally. The displacement of secular social theory by social and psychological understanding explicitly based in religious thought is explored in several domains and religious traditions. The paper emphasizes, however, a sociology created from within the streams of Jewish mysticism, and examples are offered. The line of Romanian scholars of religion, including Eliade, Idel and Culiano, is seen as less than apparently dissonant with both the sociology of religious experience, and the post-sociological turn to creating social theory from within religious, and particularly, mystical traditions. This article draws attention to the origins, forms, and implications of “toxic discourse” as a genre central to the understanding of the public sphere in business in society.RachelCarson'sSilentSpringis used as a pivotal cultural document establishing “toxic discourse” as an ongoing form of moral narrative rooted in the rationality of counterpublics. Toxic discourse is framed within a center/periphery model in which toxic discourse gains salience in periods of economic dislocation and uncertainty. In these periods, toxic discourse draws together those on the (...) periphery or counterpublics who otherwise would not unite in their opposition to the center. The article critically examines how stakeholder theory, despite making sense of the public sphere for agents of organizations, glosses counterpublics and relegates toxic discourse, as evident in the “Occupy Movement,” to the ephemeral role of temporary, disruptive protest groups with very little of substance to communicate. This article investigates the social accounts employed by 11 highly paid professionals and managers for neutralizing the moral stigma of losing their job due to resume fraud. This ethnographic study, based on 66 hours of interviews, explores the retrospective sense making used by resume fraudsters to justify, personally pardon and excuse behaviour seen as morally problematic by others. In this study the resume fraudsters sampled were selected because they all found high-paying jobs after their public humiliation, and each one morally (...) disengages. They put their transgressions behind them, not by seeing the light of day or asking for forgiveness, but by pointing to the ubiquity of information distortion in their companies, the victimless nature of their so-called transgression, and, most interesting, a portrayal of themselves and their act of resume fraud as the very type of risk taking required to instil capitalism with a passion and a will to succeed. The article closes with a discussion of how moral disengagement enlarges the zone of indifference in populations and reinforces cultures in which the pursuit of amorality thrives. (shrink)

This article takes an interdisciplinary lens to the treatment of regulatory capture (RC). RC ensues when government bureaucrats, regulators, and public sector agencies receive adverse publicity for ceasing to serve the wider collective public interest. The work is divided into four sections. The first takes the point of view of each of the participants in the capture situation and provides an overview of the three variations on the RC story. Each subsequent section focuses on a version of the story. RC (...) 1, the libertarian free market version celebrates capture as inevitable and desirable. RC 2, the regulators' communitarian take on capture places it in the context of a cycle story with regulators dutifully doing the public's shifting will. In the RC 3 version, the public finds it difficult to piece together a coherent version of the morally charged narrative. The article concludes with a discussion of the relevance of each of these three versions of RC in order to understand dominant–submissive relationships between business and government. (shrink)

Background: Ethically difficult situations are frequently encountered by healthcare professionals. Moral case deliberation is one form of clinical ethics support, which has the goal to support staff to manage ethical difficulties. However, little is known which difficult situations healthcare teams need to discuss. Aim: To explore which kinds of ethically difficult situations interprofessional healthcare teams raise during moral case deliberation. Research design: A series of 70 moral case deliberation sessions were audio-recorded in 10 Swedish workplaces. A descriptive, qualitative approach was (...) applied, using thematic content analysis. Ethical considerations: An advisory statement specifying no objections to the study was provided from an Ethical Review Board, and consent to be recorded was assumed by virtue of participation in the moral case deliberation. Findings: Three themes emerged: powerlessness over managing difficult interactions with patients and next-of-kin, unease over unsafe and unequal care, and uncertainty over who should have power over care decisions. The powerlessness comprised feelings of insufficiency, difficulties to respond or manage patient’s/next-of-kin’s emotional needs or emotional outbursts and discouragement over motivating patients not taking responsibility for themselves. They could be uncertain over the patient’s autonomy, who should have power over life and death, disclosing the truth or how much power next-of-kin should have. Discussion: The findings suggest that the nature of the ethically difficult situations brought to moral case deliberations contained more relational-oriented ethics than principle-based ethics, were permeated by emotions and the uncertainties were pervaded by power aspects between stakeholders. Conclusion: MCD can be useful in understanding the connection between ethical issues and emotions from a team perspective. (shrink)

Gadamer recordaba que en la modernidad la progresiva ruptura con el consolidado repertorio humanista y cristiano con contenidos susceptibles de recreación artística, da lugar a una nueva situación: «El artista ya no pronuncia el lenguaje de la comunidad, sino que se construye su propia comunidad al proferirse en lo más íntimo de sí mismo» (Gesammelte Werke 8, pág. 94 y ss.). Este proceso dará lugar a la inevitable conformación (...) de una nueva comunidad potencial que habrá de extenderse a todo el mundo habitado, es decir, a toda oikumene. Es interesante notar que Gadamer sostenga que esto sea así, necesariamente, y en virtud de dos razones, a saber: o bien porque toda obra de arte trasluce una visión del mundo (ora presente, ora futurible), o bien porque, para quien la contempla, y si la tal visión es ajena a uno o incomprensible o incluso inconmensurable, se presenta ésta, al cabo, como una confrontación que puede conducir al aprendizaje de la desconocida lengua de aquel y aquello que nos está hablando. Dos procesos estos complejos, enfrentados y de honda raigambre política (no sólo estética) sobre los que podría, en efecto, decirse mucho, y que aquí se resaltan para hacer ver que el arte —o bien porque trasluce una visión del mundo compartida, o bien porque nos confronta, por mediación del lenguaje, con una comprensión del mundo enteramente desconocida— es una experiencia comunitaria. Sobre esto versa la obra gadameriana antedicha, a saber: acerca de las experiencias comunitarias como instantes de actualización de lo bello. De alguna manera, es a la luz de esta problemática profusamente aquilatada en las obras del arte no figurativo del siglo XX como cabe entender la tradición estética y política en la que —según se lee en el prólogo que Gianni Vattimo ha dedicado a esta obra— se orienta cada vez más la finalidad estética de crear «acontecimientos en lugar de “objetos”» (pág. 20). Broad consent – the act of gaining one consent for multiple potential future research projects – sits at the core of much current genomic research practice. Since the 25th May 2018, the General Data Protection Regulation (GDPR) has applied as valid law concerning genomic research in the EU and now occupies a dominant position in the legal landscape. Yet, the position of the GDPR concerning broad consent has recently been cause for concern in the genomic research community. Whilst the text (...) of the GDPR apparently supports the practice, recent jurisprudence contains language which is decidedly less positive. This article takes an in-depth look at the situation concerning broad consent under the GDPR and – despite the understandable concern flowing from recent jurisprudence – offers a positive outlook. This positive outlook is argued from three perspectives, each of which is significant in defining the current, and ongoing, legitimacy and utility of broad consent under the GDPR: the principled, the legal technical, and the practical. We present evidence that preschool children oftentimes understand disjunctive sentences as if they were conjunctive. The result holds for matrix disjunctions as well as disjunctions embedded under every. At the same time, there is evidence in the literature that children understand or as inclusive disjunction in downward-entailing contexts. We propose to explain this seemingly conflicting pattern of results by assuming that the child knows the inclusive disjunction semantics of or, and that the conjunctive inference is a scalar implicature. We make (...) two assumptions about implicature computation in the child: that children access only a proper subset of the adult alternatives, and that children possess the adult capacity to strengthen sentences with implicatures. As a consequence, children are expected to sometimes not compute any implicatures at all, but in other cases they are expected to compute an implicature that is different from the adult implicature. We argue that the child’s conjunctive strengthening of disjunctive sentences realizes the latter possibility: the adult infers that the conjunction is false but the child infers that the conjunction is true. This behaviour is predicted when our assumptions about child development are coupled with the assumption that a covert exhaustive operator is responsible for strengthening in both the child and the adult. Specifically, children’s conjunctive strengthening is predicted to follow from the same mechanism used by adults to compute conjunctive free choice implicatures in response to disjunctive permission sentences. We furthermore argue that this parallel between the child and the adult extends to disambiguation preferences. In particular, we present evidence that children prefer to strengthen disjunctions to conjunctions, in matrix and embedded positions ; this result mirrors previous findings that adults prefer to compute free choice, at the root and under every. We propose a disambiguation strategy that explains the preference for conjunctive strengthening – by both the child and the adult – even though there is no general preference for exhaustification. Specifically, we propose that the preference for a conjunctive strengthening follows from a pragmatic preference for a complete answer to the Question Under Discussion. (shrink)

BackgroundMoral case deliberation is one form of clinical ethics support, and there seems to be different ways of facilitating the dialogue.PurposeThis paper aimed to explore Swedish facilitators' experiences of their role in moral case deliberations.MethodThis study had a qualitative approach with explorative design. Semi-structured interviews with eleven MCD facilitators were conducted. Their experiences were analyzed using thematic analysis.ResultBeing a facilitator was understood through the metaphor of sailing: against the wind or with it. The role was likened to a sailor's set (...) of skills: to promote security and well-being of the crew, to help crew navigate their moral reflections, to sail a course into the wind against homogeneity, to accommodate the crew's needs and just sail with the wind, and to steer towards a harbour with authority and expertise. Neurotherapies for diagnostics and treatment—such as electroencephalography (EEG) neurofeedback, single-photon emission computerized tomography (SPECT) imaging for neuropsychiatric evaluation, and off-label/experimental uses of brain stimulation—are continuously being offered to the public outside mainstream healthcare settings. Because these neurotherapies share many key features of complementary and alternative medicine (CAM) techniques—and meet the definition of CAM as set out in Kaptchuk and Eisenberg—here we refer to them as “alternative neurotherapies.” By explicitly linking these alternative neurotherapy practices under a common conceptual framework, this paper (...) draws attention to, and critically considers, the cross-cutting ethical and legal issues related to the provision of these services. The first section of this paper provides an updated empirical overview of uses of SPECT neuropsychiatric evaluations, EEG neurofeedback, and experimental/off-label forms of brain stimulation. Next, drawing on CAM bioethics scholarship, we highlight the pertinent ethical issues in the alternative neurotherapy context, including the truthful representation of evidence base, marketing to vulnerable populations, potential harms, provider competency, and conflicts of interest. Finally, we consider the principal legal issues at stake for the provision of alternative neurotherapies in the U.S., namely those related to licensing and scope-of-practice considerations.
